Website Terms of Use
These Terms of Use apply to your use of arborait.com (the “Site”), operated by Arbora Managed IT LLC (“Arbora,” “we,” “us”). By using the Site, you agree to them. If you don’t agree, please don’t use the Site. Our Privacy Policy and Cookie Policy are part of these terms. Services we provide to clients are governed by our General Terms & Conditions above and any signed agreement, not by these Terms of Use.
I. Information on this Site and about Arbora
The Site provides general information about Arbora and about technology, cybersecurity and compliance topics. It isn’t professional, legal or compliance advice for your specific situation, and reading it doesn’t create a client relationship. Every environment is different: talk with us before acting on anything you read here. Statistics, descriptions of services and pricing information may change and don’t form an offer unless included in a written quote.
II. Site use generally
A. Permitted use
You may view and use the Site for your own lawful personal or business purposes. You must be at least 18 years old, or the age of majority where you live, to submit information through the Site.
B. Prohibited use
You agree not to:
- use the Site in any way that breaks the law or infringes anyone’s rights;
- scan, probe, penetration-test or attempt to gain unauthorized access to the Site, our systems or any connected network, unless we have authorized it in writing;
- interfere with the Site’s operation, including by introducing malware or overloading it;
- use bots, scrapers or other automated means to access the Site or submit forms, except search engines indexing public pages;
- submit false information, impersonate anyone, or send spam through our forms.
C. Security reports
If you believe you’ve found a security issue with the Site, please email [email protected] with details instead of testing further. We appreciate good-faith reports.
D. Intellectual property
The Site and its content, including text, graphics, photos, video, logos and design, belong to Arbora or its licensors and are protected by copyright and trademark law. “Arbora,” “Arbora Managed IT” and our logos are our trademarks. You may share links to the Site, but you may not copy, modify or reuse its content or marks without our written permission.
E. Third-party names and links
Names and logos of technology partners and other companies belong to their owners and are used for identification only; their use doesn’t imply endorsement. Links to other websites are provided for convenience. We don’t control those sites and aren’t responsible for their content or practices.
F. Availability and changes
We may change, suspend or discontinue any part of the Site at any time, and we don’t guarantee it will always be available or error-free.
G. Changes to these terms
We may update these Terms of Use by posting a new version here with a new date. Continuing to use the Site after an update means you accept it.
III. User content
When you send us information through a form, email or text, you confirm it’s accurate and that you have the right to share it, and you allow us to use it to respond to you and provide the services you ask about, as described in our Privacy Policy. Please don’t send passwords, account numbers, health information or other sensitive data through the Site. If we need it, we’ll set up a secure way to share it. Feedback or ideas you send us may be used without obligation to you.
IV. Use of social media
We share updates and how-to content on social platforms such as YouTube and Instagram. Your use of those platforms is governed by their own terms and privacy policies. Comments and messages you post there are public and are your responsibility; we may remove or hide content on our pages that is abusive, unlawful, spam or off-topic. Following, liking or messaging us on social media doesn’t create a client relationship, and please don’t share confidential information there.
V. Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Arbora disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the Site will be uninterrupted, secure or free of errors or harmful components.
VI. Limitation of liability and remedies
To the fullest extent permitted by law, Arbora and its owners, employees and partners won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your use of, or inability to use, the Site, even if we were told they were possible. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars ($100). Your sole remedy if you’re dissatisfied with the Site is to stop using it. You agree to indemnify Arbora against claims arising from your misuse of the Site or breach of these terms. Some places don’t allow these limits, so they apply only as far as the law permits.
VII. General terms
These Terms of Use are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Kent County, Michigan, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver. These Terms of Use, together with our Privacy Policy and Cookie Policy, are the entire agreement about your use of the Site. Where they conflict with our General Terms & Conditions or a signed agreement for services, that agreement controls.
VIII. Third-Party Programs & SMS
A. Remote support software
Our “Download remote support” link provides a remote access tool from Syncro, a third-party provider. Installing and running it is optional and subject to Syncro’s own terms and privacy policy. We connect to your computer only during a support session you start with us. Help is available at [email protected] or (616) 314-5440.
B. SMS
Upon your opt-in, Arbora may use SMS to conduct customer care, appointment, account notification, and conversational SMS exchanges with you. By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Arbora Managed IT. This includes SMS messages for conversations (external). Message frequency varies. Message and data rates may apply. See privacy policy at https://www.arborait.com/privacy/. Message HELP for help. Reply STOP to any message to opt out.
